SWEEPSTAKES PERIOD: The “Pontiac is Your Dream Prize” Sweepstakes (“Sweepstakes”) begins at 12:00 AM Central Time on June 15, 2008 and ends at 11:59 PM Central Time on January 10, 2009 (“Sweepstakes Period”).
SPONSOR: General Motors Corporation, 100 Renaissance Center, Detroit, Michigan 48265.
ADMINISTRATOR: All Terrain Productions, Inc., 2675 West Grand Avenue, Chicago, Illinois 60612-1144.
AGREEMENT TO THE OFFICIAL RULES: By participating in the Sweepstakes, all entrants fully and unconditionally agree to and accept these Official Rules and Sponsor and Administrator’s decisions which are final and binding in all matters related to the Sweepstakes. Winning the prize (described below) is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER: There are two (2) ways to enter the Sweepstakes:
By mailing an official entry form or a 3” by 5” note card on which you have hand-printed your name, mailing address, e-mail address, daytime phone, date of birth and the words “Pontiac is Your Dream Prize” to Pontiac is Your Dream Prize Sweepstakes, c/o All Terrain Productions, Inc., 2675 West Grand Avenue, Chicago, Illinois 60612-1144. MAIL ENTRIES MUST BE POSTMARKED BY JUNE 15, 2008 AND RECEIVED BY JANUARY 10, 2009.
Entries will not be returned. Sponsor and Administrator assume no responsibility for lost, mutilated, late or misdirected entries. Limit: One (1) entry per person regardless of entry method used.
By visiting www.pontiacisyou.com and filling out and submitting the official entry form, on or before January 10, 2009.
PRIZE.The following prize will be awarded: Prize to be determined jointly by Sponsor, Administrator and the winner. The prize’s approximate value is Ten Thousand Dollars ($10,000.00).
DRAWING. The prize’s approximate retail value is Ten Thousand Dollars ($10,000.00). The winner will be determined at a random drawing to be held on or about January 10, 2009, and will be notified by phone or mail on January 11, 2009. If the prize is not claimed by January 13, 2009, a second-chance drawing will take place on January 14, 2009. Participants in the second-chance drawing will consist of all non-winning entrants, who will automatically be entered in the second-chance drawing. The second-chance winner must claim the prize by January 30, 2009. If the prize is not claimed by that date it will not be awarded.
ODDS OF WINNING. Odds of winning are estimated to be approximately 1 in 100,000 and will depend upon the number of eligible entries received from all entry methods.
ELIGIBILITY. The Sweepstakes is open only to persons who, at the time of entry, are legal residents of the District of Columbia or any state besides Alaska, Florida, Hawaii, New York or Rhode Island and are 18 years of age or older. Employees, directors and officers and their immediate families (husbands, wives, brothers, sisters, parents and children and their spouses) and household members of Sponsor, Administrator, GM R*Works, and their respective subsidiaries and affiliates, and companies involved in the implementation and execution of the Sweepstakes (collectively the "Sweepstakes Entities") are not eligible. By entering the Sweepstakes, participants agree to be bound by these rules. The winner will be required to sign an affidavit of eligibility and a publicity release that will allow use of the winner's names and likenesses by the Sponsor. All taxes (not limited to income, federal, state and local) are the responsibility of the winner. Information collected from entrants is subject to the General Motors Corporation Privacy Policy available at www.gm.com/privacy/. All expenses not described as part of the prize, including but not limited to travel, lodging and meals, are the sole responsibility of the winner.
WINNERS' LIST. For the name of the winner, please send a self-addressed stamped envelope to Pontiac is Your Dream Prize Sweepstakes, c/o All Terrain Productions, Inc., 2675 West Grand Avenue, Chicago, Illinois 60612-1144. Requests for winner’s name must be received by June 30, 2009. Allow four to six weeks for delivery of the list.
GENERAL PRIZE RESTRICTIONS. The prize is subject to availability and is subject to change. The prizes may not be transferred or assigned. No cash or other substitution may be made, except by the Administrator, who reserves the right to substitute the prize in whole or in part with another prize of comparable or greater value if the intended prize is not available for any reason as determined by the Administrator in its sole discretion. The winner will be responsible for obtaining all passports, visas and other documents for international travel, all applicable taxes (not limited to federal, state, local and/or income) and will be required to provide his or her Social Security number for tax reporting purposes. Administrator will file where required an IRS Form 1099 with the Internal Revenue Service for the fair market value of any prize.
GENERAL CONDITIONS AND RELEASE. By participating, entrants (and if an eligible minor, their parents or legal guardians) (a) release Sweepstakes Entities, their respective directors, officers, agents and employees from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize except where prohibited by law; (b) consent to the use by Sponsor of the winner’s name, hometown, likeness, statements and other personally identifiable information for promotion, advertising and marketing purposes in any media throughout the world without additional consideration and consent or prior review, and upon request will provide written consent to such use; and (c) acknowledge that no one has either made or is in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize including, but not limited to, its quality or availability. Neither Sweepstakes Entities nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost or delayed data or voice transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or website or to complete a telephone call or facsimile transaction, or any other error or malfunction, or late, lost or misdirected mail, or any injury or damage to an entrant’s or any other person’s computer related to or resulting from participation in this Sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Sweepstakes is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other causes which in the opinion of Administrator, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Administrator reserves the right at its sole discretion to disqualify any suspect entry or entrant and to cancel, terminate, modify or suspend the Sweepstakes. In the event of any cancellation, termination or suspension, notice thereof will be posted at the Website and the determination of the prize winner will be made, from among all eligible, non-suspect entries received as of the date of the termination, cancellation or suspension, as Administrator determines in its sole discretion.
